Summary
These General Terms of Use ("Terms") define the conditions under which any user may access and use the website clarifyconsult.com published by Clarify Consult Partner Europe. Access implies full and unreserved acceptance of these Terms.
1. Article 1 - Acceptance
The user acknowledges having read these Terms prior to use and expressly accepts them without reservation. Otherwise, the user must immediately cease all use.
2. Article 2 - Access conditions
2.1. Access is exclusively reserved for professional Clients, excluding any consumer.
2.2. Access requires the creation of an account by a legal representative of the Client. The user warrants the accuracy of information provided.
2.3. The user is solely responsible for the confidentiality of their credentials. They undertake to inform the Company without delay of any loss or theft at [email protected].
2.4. Multi-factor authentication is mandatory for administrator accounts.
3. Article 3 - User conduct
The following are notably prohibited:
- Any activity contrary to applicable laws and regulations
- Any intrusion attempt or circumvention of security measures
- Any reverse engineering or copying of source code
- Any unauthorised automated use (bots, scripts)
- Uploading unlawful or counterfeit content
- Transmission of viruses or malware
- Identity theft
- Sharing credentials with a third party
4. Article 4 - User content
Client Data remains the exclusive property of the Client. The Company acts as processor within the meaning of article 28 GDPR. The user warrants holding all rights necessary to deposit this data.
5. Article 5 - Service availability
The Company makes all reasonable efforts to ensure 24/7 availability, excluding scheduled maintenance interruptions.
6. Article 6 - Evolutions
The Company may evolve the Services. These evolutions are included in the subscription fee and do not entitle to compensation, unless they involve substantial removal of an essential feature.
7. Article 7 - Suspension and termination
The Company may suspend access without notice in case of breach. Suspension may lead to termination at the Client's expense.
8. Article 8 - Support
Support provided Monday to Friday 9 AM-6 PM CET. Requests by email to [email protected]. Response within 4 business hours.
9. Article 9 - Technical compatibility
Services compatible with recent versions of Firefox, Chrome, Edge, Safari. The Company may discontinue support for obsolete versions.
10. Article 10 - Limitations of liability
The Services is provided "as is". Liability is limited in accordance with the GTS.
11. Article 11 - Electronic notifications
Any notification may be transmitted electronically to the user's address. Electronic communications meet the legal requirements of written form.
12. Article 12 - Modifications
The Company may modify these Terms at any time. Modifications come into effect 30 days after publication. Continued use constitutes acceptance.
13. Article 13 - Applicable law
These Terms are governed by Belgian law. Any dispute shall be subject to a prior amicable resolution attempt. Failing agreement within 60 days, the courts of the Brussels judicial district shall have exclusive jurisdiction.
